The Constitutional Case Against The Federal Sports Gambling Ban

The Federal ban on sports betting has been blasted by anyone who knows anything about the subject for a number of different reasons. Though the US professional leagues suggest that sports betting threatens the integrity of their games, the opposite is the case. The professional bookmaking industry is usually where any type of compromised or fixed game is discovered. Ultimately, the best case for legal sports betting is Constitutional.

Unfortunately, the Congress of the United States has shown very little respect for the Constitution in recent years. Were it to abide strictly by the role outlined for it by the founding fathers, the Legislative Branch of our government would have to relinquish any number of its powers in a variety of areas. The primary problem with our Congress is that it has increasingly become a collection of career politicians rather than a body representative of its constituency. As a result, the overriding concern of the average Senator or Congressman is increasing the power that he is able to wield, and as a result the power that his body is able to bring to bear.

The Federal prohibition of sports wagering which was enacted a few years back is of very dubious Constitutionality. Were it not for the grandfather clause, which allowed it to remain legal in jurisdictions in which it already existed, it would have certainly been struck down as unconstitutional on a number of different fronts. Ironically, the gambling industry supported this bill in the pre-Internet era.

Unfortunately, the mere fact that a proposed law or initiative is unconstitutional offers little protection for the citizenry. In fact one of the most important concepts in the Constitution”that of the right to sovereignty and self-determination of the individual states”is one of the most frequently abused. For those of you not up on the Constitution (and if youre not, you certainly should be), lets consider the 10th Amendment:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Under the 10th Amendment, unless the power in question has been expressly given to the Federal government by the Constitution, and/or unless it has expressly been prohibited to the states to govern as it sees fit. If an individual state chooses not to regulate a certain activity, it is the right of each individual citizen to make their own decision.

So, you should be asking yourself at this point, where exactly does the Constitution delegate to the Federal government the right to make policy on sports gambling? The answer is that it doesnt, and it is very questionable that they have the Constitutional authority to do so. Fortunately for all freedom loving Americans the founding fathers would beg to differ.

Sports gambling may seem a minimally important issue to some, but the erosion of liberty is an incremental danger. The danger to broader concepts of personal liberty may seem a million miles away, but with each additional law intended to protect us from this or that the Federal government becomes larger and more powerful and the rights of the sovereign states”and the individuals that comprise them”are shrinking and being weakened.

Pittsburgh Tops Cleveland For 12th Consecutive Time

The Pittsburgh Steelers have been playing the Cleveland Browns for longer than any other team in the National Football League, dating back to’50. And while it hasn’t been quite that long since the Cleveland Browns won a game against the Steelers it may be starting to feel like it. On Sunday, Pittsburgh won for the twelfth straight time dating back to 2003 as they topped Cleveland by a final score of 27-13.

The good news for NFL betting enthusiasts who took the +13′ with the Browns as a road underdog is that they managed to cover the pointspread by the slimmest of possible margins. Betting against the defending Superbowl champion is a long standing handicapping concept, and this season at least its worked like a charm-the Steelers have only covered one of their first six games. Cleveland, meanwhile, evened their NFL pointspread record at 3-3 on the season. The Browns have covered three straight after dropping their first three both straight up and against the spread. The 40 combined points went OVER the posted total of 37′.

Pittsburgh dominated the game in virtually every statistical category. They amassed 28 first downs to 12 for Cleveland, held a 543 to’7 total yardage advantage and a 36:46 to 23:14 time of possession advantage. Both teams turned the ball over four times, and the Steelers led only 17-14 in the third quarter. Most of the post game talk from both sides was about a controversial spot in the first half where the Steelers were given a first down on a short yardage play when it appeared that they didn’t make the required yardage.

After the contest, Derek Anderson spoke of the frustration of continually coming up short against the Steelers. The Browns have only one once in ten games since Pittsburgh moved into their new home at Heinz Field:

“We’re not trying to lose every time we go out here. We put tons of hours in and … it’s frustrating. Every single week, it’s frustrating.”

Steelers’ tight end Heath Miller said the team is happy to be where they are at this point despite not playing up to their standards:

“I think we haven’t played our best ball yet and that’s pretty comforting. We’ve gotten a few wins here without playing our best.”

The Steelers will host Brett Favre and the 6-0 Minnesota Vikings next Sunday. The Steelers are a -4 home favorite with the total set at 45. After a bye week, the Steelers will hit the road to play another undefeated team as they take on the Denver Broncos on Monday, November 9. Cleveland will host the Green Bay Packers this Sunday, with the Browns a +7 home underdog and the total set at 42′. They’ll head to ‘The Windy City’ to face the Chicago Bears the following Sunday and then have a bye week.
